Terms of Service

1. Introduction
These Terms of Service ("Terms") govern access to and use of the website and software platform operated by Kynto SAS ("Kynto", "we", "us", "our"), including all related features, tools, and services (collectively, the "Service").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
2. Eligibility, Scope and Authority
The Service is intended exclusively for professional and business use.
By using the Service, you represent and warrant that:
- • you act on behalf of a legal entity,
- • you have the authority to bind such entity to these Terms,
- • you are at least 18 years old.
Use of the Service for personal, consumer, or non-professional purposes is strictly prohibited.
3. Account Creation and User Access
Accounts may be created by company administrators and accessed by authorized users invited within the same organization.
You are responsible for:
- • safeguarding login credentials,
- • ensuring that only authorized users access the Service,
- • all actions performed through your account.
Kynto shall not be liable for unauthorized access resulting from failure to protect credentials.
Kynto reserves the right to suspend, restrict, or terminate accounts in case of suspected misuse, security risk, or violation of these Terms.
4. Description of the Service
Kynto provides a SaaS platform designed to support recruitment processes, including:
- • recruitment workflow management,
- • candidate organization and evaluation,
- • AI-assisted analysis, scoring, summaries, and recommendations,
- • interview scheduling and coordination tools.
The Service is provided solely as a decision-support tool.
Kynto does not:
- • replace human judgment,
- • make hiring decisions,
- • guarantee recruitment outcomes or compliance with employment laws.
All recruitment decisions remain under the exclusive responsibility of the customer.
5. Artificial Intelligence and Automated Processing
The Service may use artificial intelligence technologies to:
- • analyze candidate information provided by customers,
- • generate scores, summaries, and recommendations,
- • assist with interview preparation and post-interview analysis.
AI-generated outputs:
- • are probabilistic by nature,
- • may contain inaccuracies or biases,
- • must be reviewed and validated by human users.
Kynto does not perform automated decision-making within the meaning of Article 22 of the GDPR.
Strict Data Segregation
For the avoidance of doubt:
- • Artificial intelligence features operate exclusively on data explicitly provided by customers through the Kynto platform.
- • No data obtained via Google APIs, including Google Calendar or other Google user data, is ever transmitted to, processed by, or used within any artificial intelligence system or third-party AI service.
- • Google API user data is never used for AI training, fine-tuning, inference, analytics, or model improvement.
6. Acceptable Use and Customer Obligations
You agree to use the Service in compliance with:
- • applicable labor and employment laws,
- • anti-discrimination regulations,
- • data protection and privacy laws, including the GDPR.
You shall not use the Service to:
- • unlawfully discriminate against individuals,
- • process personal data without a valid legal basis,
- • monitor or surveil individuals,
- • infringe the rights of candidates or third parties.
You are solely responsible for:
- • the legality, accuracy, and relevance of the data you upload,
- • obtaining any required consent or legal authorization.
7. Data Protection and GDPR
For the purposes of the GDPR:
- • the customer acts as data controller,
- • Kynto acts as data processor.
Personal data is processed in accordance with:
- • the Privacy Policy, and
- • the Data Processing Agreement (DPA) incorporated by reference into these Terms.
Kynto processes personal data solely on documented instructions from the customer.
In the event of a data subject request, the customer remains responsible for determining and implementing the appropriate response.
7 bis. Google API User Data
When users connect their Google account to the Service, Kynto may access certain Google user data (such as Google Calendar events) strictly to provide calendar synchronization and interview scheduling features.
Google API user data:
- • is used solely for user-requested functionality,
- • is processed in accordance with the Google API Services User Data Policy and its Limited Use requirements.
Google API user data is never transmitted to, processed by, or shared with any artificial intelligence service or third-party AI provider.
Such data is not used to train, fine-tune, analyze, or improve any generalized or proprietary AI models.
8. Subscriptions, Fees and Payment
Access to the Service is provided on a paid subscription basis, billed monthly or annually at the customer's choice.
Payments are processed via Stripe.
Unless otherwise stated:
- • fees are non-refundable,
- • no refunds are provided for partial subscription periods.
In case of non-payment, Kynto may suspend or restrict access until payment is received.
9. Term, Suspension and Termination
These Terms remain in effect for the duration of the subscription.
The customer may terminate the subscription:
- • at the end of the applicable billing period,
- • subject to the selected billing cycle.
Kynto may suspend or terminate access:
- • for maintenance or security reasons,
- • to comply with legal obligations,
- • in case of breach of these Terms.
Termination does not affect accrued payment obligations.
10. Intellectual Property
All intellectual property rights relating to the Service, including:
- • software,
- • interfaces,
- • algorithms,
- • models,
remain the exclusive property of Kynto.
Customers retain ownership of their data and content.
Kynto may use anonymized and aggregated data for product improvement, analytics, and service optimization purposes, excluding any data obtained via Google APIs.
11. Limitation of Liability
To the maximum extent permitted by law:
- • Kynto shall not be liable for recruitment decisions or outcomes,
- • Kynto shall not be liable for indirect or consequential damages, including loss of profit, revenue, or opportunity.
Kynto's total liability shall not exceed the total fees paid by the customer during the twelve (12) months preceding the claim.
12. Force Majeure
Kynto shall not be liable for failure or delay resulting from events beyond its reasonable control, including network failures, infrastructure outages, or governmental actions.
13. Governing Law and Jurisdiction
These Terms are governed by French law.
Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Paris, France.
