Terms of Service

1. Introduction
These Terms of Service ("Terms") govern access to and use of the website and software platform operated by Kynto SAS ("Kynto", "we", "us", "our"), including all related features, tools, and services (collectively, the "Service").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
2. Eligibility and Authority
The Service is intended exclusively for professional and business use.
By using the Service, you represent and warrant that:
- • you act on behalf of a legal entity,
- • you have the authority to bind such entity to these Terms,
- • you are at least 18 years old.
Use of the Service for personal, consumer, or non-professional purposes is strictly prohibited.
3. Account Creation and User Access
Accounts may be created by company administrators and accessed by authorized users invited within the same organization.
You are responsible for:
- • safeguarding login credentials,
- • ensuring that only authorized users access the Service,
- • all actions performed through your account.
Kynto shall not be liable for unauthorized access resulting from failure to protect credentials.
Kynto reserves the right to suspend, restrict, or terminate accounts in case of suspected misuse, security risk, or violation of these Terms.
4. Description of the Service
Kynto provides a SaaS platform designed to support recruitment processes, including:
- • recruitment workflow management,
- • candidate organization and evaluation,
- • AI-assisted analysis, scoring, summaries, and recommendations,
- • automated qualification interviews,
- • interview scheduling and calendar coordination,
- • candidate sourcing features, including profile search and contact enrichment.
The Service is provided solely as a decision-support tool. Kynto does not replace human judgment, make hiring decisions, or guarantee recruitment outcomes. All recruitment decisions remain under the exclusive responsibility of the customer.
5. Free Trial
Kynto may offer a free trial period to new customers. During this period:
- • access to the Service is provided at no charge for the duration specified at registration,
- • all applicable Terms remain in full effect,
- • Kynto reserves the right to modify or discontinue free trial offers at any time without notice,
- • at the end of the trial period, continued access requires activation of a paid subscription.
No payment information is required to access a free trial unless explicitly stated during registration.
6. Subscriptions, Credits and Payment
Subscriptions
Access to the Service is provided on a paid subscription basis, billed monthly or annually at the customer's choice. Payments are processed via Stripe.
Unless otherwise stated:
- • fees are non-refundable,
- • no refunds are provided for partial subscription periods.
In case of non-payment, Kynto may suspend or restrict access until outstanding amounts are settled.
Sourcing Credits
Certain features of the Service, including candidate contact enrichment, operate on a credit-based system. Credits are consumed upon use of eligible features.
Key rules governing credit usage:
- • credits are deducted at the time an enrichment action is initiated,
- • if an enrichment attempt does not return a result, the corresponding credits are automatically refunded,
- • customers are responsible for monitoring their credit balance prior to initiating enrichment actions,
- • credits have no cash value and are non-transferable.
Detailed credit pricing and allocation are set out in the applicable subscription plan.
7. Artificial Intelligence and Automated Processing
The Service uses artificial intelligence technologies to analyze candidate information, generate scores, summaries, and recommendations, and assist with interview preparation and analysis.
AI-generated outputs:
- • are probabilistic by nature,
- • may contain inaccuracies,
- • must be reviewed and validated by a human user before any decision is made.
Kynto does not perform automated decision-making within the meaning of Article 22 GDPR. All recruitment decisions remain the exclusive responsibility of the customer.
AI models used by Kynto operate exclusively on data provided by customers through the platform. No data obtained via Google APIs is ever transmitted to or processed by any AI system.
8. Acceptable Use and Customer Obligations
You agree to use the Service in compliance with applicable labor, employment, anti-discrimination, and data protection laws, including the GDPR.
You shall not use the Service to:
- • unlawfully discriminate against individuals,
- • process personal data without a valid legal basis,
- • monitor or surveil individuals beyond the scope of legitimate recruitment activities,
- • infringe the rights of candidates or third parties.
You are solely responsible for the legality, accuracy, and relevance of the data you upload or process through the Service, and for obtaining any required consent or legal authorization.
9. Data Protection and GDPR
For the purposes of the GDPR:
- • the customer acts as data controller,
- • Kynto acts as data processor.
Personal data is processed in accordance with the Privacy Policy and the Data Processing Agreement (DPA) incorporated by reference into these Terms. Kynto processes personal data solely on documented instructions from the customer.

10. Google API User Data
When users connect their Google account, Kynto may access Google Calendar data solely to provide calendar synchronization and interview scheduling features. Google API user data:
- • is used exclusively for user-requested functionality,
- • is never used for advertising, analytics, profiling, or AI processing,
- • is never sold or shared with third parties,
- • is processed in accordance with the Google API Services User Data Policy and its Limited Use requirements.
11. Service Availability
Kynto makes reasonable efforts to ensure the availability and continuity of the Service. However, Kynto does not warrant uninterrupted or error-free access. The Service may be temporarily unavailable due to maintenance, infrastructure updates, or events beyond Kynto's reasonable control.
Kynto will endeavor to provide advance notice of planned maintenance where reasonably practicable.
12. Intellectual Property
All intellectual property rights relating to the Service, including software, interfaces, algorithms, and models, remain the exclusive property of Kynto.
Customers retain full ownership of their data and content uploaded to the platform.
Kynto may use anonymized and aggregated data for product improvement and service optimization purposes. This excludes any data obtained via Google APIs.
13. Limitation of Liability
To the maximum extent permitted by applicable law:
- • Kynto shall not be liable for recruitment decisions or their outcomes,
- • Kynto shall not be liable for indirect or consequential damages, including loss of profit, revenue, data, or business opportunity.
Kynto's total aggregate liability shall not exceed the total fees paid by the customer during the twelve (12) months preceding the claim.
14. Force Majeure
Kynto shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to network failures, infrastructure outages, cyberattacks, or governmental actions.
15. Modifications to the Terms
Kynto reserves the right to update these Terms at any time. Customers will be notified of material changes with reasonable advance notice. Continued use of the Service following notification constitutes acceptance of the revised Terms.
16. Term and Termination
These Terms remain in effect for the duration of the active subscription.
The customer may terminate the subscription at the end of the applicable billing period. Termination does not entitle the customer to a refund of fees already paid.
Kynto may suspend or terminate access for maintenance, legal compliance, or breach of these Terms. Termination does not affect any accrued payment obligations.
Upon termination, customers may export their data in accordance with the conditions set out in the applicable DPA.
17. Governing Law and Jurisdiction
These Terms are governed by French law.
Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Paris, France.
